The remedies provided herein are Renter’s sole and exclusive remedies. In no event shall RI be liable for direct, indirect, special, incidental or consequential damage (including loss of profits) whether based on contract or any other legal theory. RI makes no warranty expressed or implied that the item is fit for any particular purpose. |

Payment Terms

Payment to RI will be at the time the Renter/Buyer submits a rental or Buy-Instead request. Any payments or partial payments are collected by RI for rentals or rental reservations at this time. Payment will be solely through credit card and no other payment method will be accepted. All payments from Renter to Owner will be through AlertPay and will occur once the Owner has successfully checked their item back in after the completion of a rental transaction. Or in the case of “Buy-Instead”, the payment will be sent to the Owner when the item ships out/is transported to the Renter/Buyer. Any discounts for which the Owner and Renter have agreed to, will be paid to the Renter upon successful check-in of the item by the Owner.

Shipment/Delivery

All shipping costs, including cost of insurance are payable by Renter unless otherwise negotiated between Owner and Renter. IT IS THE RESPONSIBILITY OF THE RENTER TO NOTIFY OWNER IF THE ITEM ARRIVES DAMAGED OR IF THE ITEM IS NOT RECEIVED WITHIN THE ESTIMATED SHIPPING ARRIVAL TIME. RI shall not be liable for delays in performance for any reason. Any disputes in Shipment/Delivery will be between Renter and Owner.

5. For a Renter renting any item: Renter will ensure that home owner’s insurance is in effect and will cover liability and damage resulting from use of rented items.

Inspection

Any item not being found to be safe will not be used or if becoming unsafe will not be used further until repairs are made. If the item has been shipped, the Renter, upon receipt of the item, will immediately inspect item and determine usability and safety. If any discrepancies are found the Renter will immediately notify Owner and appropriate arrangements will be made between them. Should the item become unsafe, unusable, or fail to perform as advertised, the Renter will immediately inform the Owner. |

Default

Should Renter default in its obligations, Owner agrees to hold harmless RI for any expenses incurred by Owner in recovering the item or monies due and enforcing its rights. RI shall be entitled to recover its legal fees and expenses whether or not formal legal action is instituted.

Any required notices shall be given in writing at the legal address of RI as shown on the WEB site or to such other address as RI provides as its legal address.

Assignment

Neither RI, Renter, nor Owner may assign or transfer any rights, duties, or obligations herein without the prior written consent of the other, and any purported attempt to do so shall be null and void. The Renter can neither lend nor sub-let the item without the Owner’s express written authorization. The Renter agrees not to use the Item for any illegal purposes or in a manner that is contrary to moral and social standards.

Waiver

Should RI choose not to exercise any of its rights, that shall not constitute or be deemed a waiver or forfeiture of such rights.

Errors

Stenographic, typographic and clerical errors in this agreement and any other agreements provided for Renter and Owner are subject to correction and Owner and Renter hereby agree to abide by the intent of the document.

Ownership

Rental item remains the property of the Owner unless Renter and Owner agree otherwise. Renter shall not remove, deface, or obscure ownership labels. The item will not be used for any illegal activities.

Item Usage

Renter shall not make any alterations, additions, modifications, or improvements to the item and shall use it only for the purpose and in the manner for which the manufacturer intended it.

Renter Obligations

Renter is responsible for all damage to item due to abuse, misuse, or negligence. Renter agrees to pay the charges to repair item so damaged. Item shall be returned to Owner in good condition and repair; wear from reasonable and proper use is accepted. Renter is responsible for loss or damage to item from theft, mysterious disappearance, fire or any other cause including but not limited to natural disasters. In accepting liability for the safe keeping of all rented items, Renter agrees to pay Owner the replacement cost (as determined by mutual agreement of Renter and Owner) of any such items which Renter is for any reason unable to return to Owner at the end of the rental period. If an agreement cannot be reached, Renter and Owner agree to accept exercising the damage deposit hold up to the maximum amount held, as full renumeration to the Owner. Rental charges will continue beyond the specified rental term, at the specified rental charge, until item is returned to Owner or Renter reimburses Owner for the replacement cost of the item. For any days past the Scheduled Return Date that the Owner does not get their item back (except in the case of a commercially shipped item which ships back on or prior to the Scheduled Ship Back Date), the Owner has the option to charge a late fee equal to three (3) time the normal rental fee, for each day the item is late. It is up to the Renter to return the item to Owner in packaging that will ensure item arrives to Owner undamaged. The Renter will not loan, re-rent, or sell the rented item. The item will remain in the Renter’s possession for the duration of the rental. The Renter will not hold the Owner responsible for any claim resulting from the use of the rented item. The Renter will return the item to the Owner on the day and time agreed (Scheduled Return Date).

Owner Obligations

Upon the return of the item to the Owner, an inspection will be performed. The Owner will inform the Renter of any discrepancies and appropriate remedies will be determined between Owner and Renter. The Owner may report the item stolen if the item is not returned by the Scheduled Return Date and the renter has not contacted the owner to extend the rental and the delay is not caused by a delay in shipping.

Rental Cancellations

By Renter

A Renter may cancel a reservation where no deposit has been placed without penalty. If a reservation deposit is in place and Renter cancels the reservation, deposit is forfeited according to the following schedule:

Refund = 100% if reservation is cancelled within 5 days of rental request submission.

Refund = 50% if reservation is cancelled more than 10 days from first day of rental but not within 5 days of rental request submission.

Refund = 0% if reservation is cancelled within 10 days of rental start date.

By Owner

Owner may cancel future reservations at any time without penalty. Owner may not cancel Rentals In-Progress or for which a Shipping Tracking Number has already been entered, but may choose to not allow extensions, rent to own, or buy it now at Owner’s discretion. Owner may not keep any portion of any reservation deposit or rents that have been collected if he/she decides to cancel a rental. The Renter will be reimbursed any rental and shipping fees collected, minus any fees imposed by AlertPay.

Rent to Own

A Renter may elect to choose the Rent to Own option if an Owner allows this option. Owner must be willing to accept the Buy-Instead terms which state that the Renter may buy the item at the Owners listed Buy-Instead price – the sum of the accrued percentages of rent allowed purchasing the item. The Owner will specify in the listing of the item what the purchase price is and how much of the rent will be allowed toward the purchase price. RI will then calculate the number of payments the renter must make to own the item. RI will hold the Owner required deposit. The deposit and 1st month’s payment will be ensured at time of selecting RTO. If funds are unavailable, the transaction is cancelled. Renter may reapply when funds are available and RTO conditions are still in place. RTO may not be selected greater than 14 days from the start of the rental transaction. An automatic recurring payment reminder will be setup. If at any time the Renter changes their mind about Rent to Own, they may return the item and it will be treated as a standard rental and all terms and conditions for a standard rental will apply. Items will be returned by the next scheduled payment plus 1 day for non-shipped items and next scheduled payment plus calculated shipping time and 1 day for shipped items. Recurring payments will be stopped after transaction is completed or terminated. No refunds will be due to the Renter for an early return.

Triple Rental Fees

In the event a Renter fails to return item on the scheduled return date and does not obtain an extension or exercise a “Buy-Instead, Triple rental fees will be available to be applied by the Owner at his/her discretion. For a shipped item, triple fees will start the day after the scheduled ship back date if the item was not placed with the designated shipping agent on the Scheduled Ship Back Date. For a non-shipped item, triple fees will start on the day after the scheduled return date if the item has not been returned to the Owner by the Scheduled Return Date.

Rental Extensions

A Rental transaction may be extended if the calendar is not already booked for the proposed extension time. A Renter may extend the Rental period by booking the Item for the proposed extension time and paying the additional rental fees. Rental rates will remain the same as for the original transaction, no further deposit will be required and the Ship Back date will be automatically adjusted for the new transaction period.

Unacceptable Rental

A Renter may elect to classify a Rental experience as Unacceptable. Doing this forms the basis of a possible Rental discount. A Renter may exercise this option at any time during the Rental Period within the Rent Instead website. Grounds may include but are not limited to: Late Arrival, Missing Parts or Accessories, In a Worse Condition Than That Identified by Owner, Unsafe, Fails During Normal Use, or Poor Communication On the Part of the Owner. The final amount of any Unacceptable Rental discount must be agreed to by both the Owner and the Renter through the negotiation steps included in the Unacceptable Rental process.

Removal of RI Customers

At any time Rent Instead may remove a User for any cause deemed justified by Rent Instead. These causes could include but are not limited to: Illegal activities, Violation of Rent Instead Policies, and Failure to Pay Rents and Fees that are Owed. Removal may be done without prior notification to the User. An email follow-up will be sent to any User that is removed explaining why they were removed and any recourse that may exist to them to be reinstated.

Special Instructions

Any special instructions for the Renter in the Rental Agreement or other instructions or requirements set out by the Owner, are to be considered in addition to Rent-Instead's Terms and Conditions, unless they are in conflict with Rent-Instead's Terms and Conditions as described herein. If Owner's special instructions, either written or verbal, conflict in any way with Rent-Instead's Terms and Conditions, Rent-Instead's Terms conditions will preside/override, without exception. Special Instructions and these Terms and Conditions form the basis of the rental agreement contract between Owner and Renter.

RI has no control over and does not guarantee the quality, safety or legality of items advertised, the truth or accuracy of users’ content or listings, the ability of Owners to rent or sell items, the ability of Renters to pay for items, or that an Owner or Renter will actually complete a transaction. |

We do not transfer legal ownership of items from the Owner to the Renter, and nothing in this agreement shall modify any governing provisions under which legal ownership of an item is transferred upon physical delivery of the item to the Owner by the Renter. Further, we cannot guarantee continuous or secure access to our services, and operation of the site may be interfered with by numerous factors outside of our control.

You agree that any claim or dispute you may have against RI must be resolved by a court located in Brevard County, Florida, except as otherwise agreed by the parties. You agree to submit to the personal jurisdiction of the courts located within Brevard County, Florida for the purpose of litigating all such claims or disputes. |
• Arbitration Option - For any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000, the party requesting relief may elect to resolve the dispute in a cost effective manner through binding non-appearance-based arbitration. In the event a party elects arbitration, they shall initiate such arbitration through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

All claims filed or brought contrary to the Resolution of Disputes Section shall be considered improperly filed. Should you file a claim contrary to the Resolution of Disputes Section, RI may recover attorneys' fees and costs up to $1000, provided that RI has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim. |
